A new Alabama law that places vaping under the same indoor restrictions as traditional smoking will take effect October 1, 2026. Passed as Senate Bill 9 during the 2026 legislative session, the law amends the state's Clean Indoor Air Act to include electronic nicotine delivery systems in the definition of "smoking." This means vaping is prohibited anywhere smoking is already banned, covering most enclosed public areas such as hospitals, restaurants, workplaces, and airports. The legislation, sponsored by Sen. Gerald Allen, also renames the law the Alabama Vivian Davis Figures and Barbara Drummond Clean Indoor Air Act. Existing exceptions for bars, tobacco stores, and designated smoking areas remain. Gov. Kay Ivey signed the bill in April as part of a package of health-related bills.
