Australia's TGA fined Suryam Energy Pty Ltd $39,600 for allegedly illegally supplying vaping goods at a New South Wales service station.

Summary

In August 2026, the Therapeutic Goods Administration (TGA) issued two infringement notices totalling $39,600 to New South Wales-based company Suryam Energy Pty Ltd for the alleged unlawful supply of vaping goods. The TGA acted on reports from members of the public that vaping goods were being supplied at a service station operated by Suryam Energy in the Wandandian area. Following an investigation, the two infringement notices were issued and both were paid in full in September 2026. It is illegal for general retailers, including tobacconists, convenience stores and service stations, to sell any vaping goods; therapeutic vapes for smoking cessation or nicotine dependence management are only available from participating pharmacies where clinically appropriate. The TGA stated it takes all allegations of non-compliance seriously and that non-compliance may result in regulatory action, including infringement notices or civil or criminal proceedings, in line with its compliance framework. The action reflects the TGA's ongoing commitment to detect, deter and disrupt the unlawful supply of therapeutic goods and vaping goods, as outlined in its Compliance Principles 2026 and 2027. Suspected non-compliance can be reported to the TGA online.
