West Virginia has begun implementing the Vape Safety Act (House Bill 5437), which introduces strict new requirements for vapor products sold in vape and smoke shops. The law mandates that products carry health warnings, legal-age notices, manufacturer information, and ingredient disclosures. To ensure compliance, the West Virginia Alcohol Beverage Control Administration (WVABCA) is overseeing a new licensing process with a fee of US$1,200; failure to obtain a license can result in fines up to US$10,000 and imprisonment.
The legislation is a response to high youth vaping rates in the state, which stand at 27.5% among high school students—significantly higher than the national average of 18%. Beyond immediate labeling requirements, the law introduces phased restrictions: starting March 1, 2027, packaging that references candy, cartoons, or non-vaping consumer products (like USB drives) will be banned. Further advertising restrictions, including strict limits on exterior signage fonts and sizes, will take effect on July 1, 2027.
