Pennsylvania begins enforcement of vape product restrictions under Act 57
Summary
Pennsylvania has started enforcing Act 57, which bans the sale of vape and e-cigarette products not listed on the state-approved Electronic Nicotine Delivery System (ENDS) directory. Attorney General Dave Sunday encouraged businesses with soon-to-be illegal products to comply. Products must be FDA-approved or under consideration and then applied to his office for directory inclusion. Act 57, passed last year with bipartisan support, aims to keep harmful products from children and adults. Currently, the directory includes 159 approved products from six manufacturers. Selling unlisted products can lead to fines or license suspension/revocation. Rep. Arvind Venkat, a co-sponsor, emphasized consumer safety and health risks, including severe lung damage and nicotine addiction. Vape industry workers warn of store closures and job losses, noting that vape shops may have to pull 90-95% of inventory, potentially driving customers to neighboring states. Erica, an industry worker, calls for individual accountability and an extension of the enforcement date to allow pending applications to clear.
