Retailers face looming deadline as Pennsylvania enforces new vape compliance law
Summary
Pennsylvania Attorney General Dave Sunday announced that enforcement of Act 57, a law banning the sale of electronic nicotine delivery systems (ENDS) products not on the state's approved product list, will begin Monday, Oct. 19. The attorney general's office is responsible for building and publishing the approved list, which is available online along with forms and FAQs. To gain approval, companies must demonstrate compliance with Act 57 and state law; approval is limited to products FDA has authorized, those with timely filed applications still under review, or those subject to a stayed denial order. The office will maintain a public directory listing approved manufacturers, brand names, categories, product names, and flavors. Non-nicotine electronic cigarettes sharing an ENDS brand name must be certified as nicotine-free with lab testing. Sunday emphasized the law aims to keep harmful products from children and adults, and praised bipartisan legislative support.
